By accessing or using xcl4w2 ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform.

xcl4w2 provides an e-commerce platform that enables users ("Merchants") to create online stores, list products, and accept payments from both AI agents and human customers. The Platform supports x402 payment protocol and traditional payment methods.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials, including API keys. You are fully responsible for all activities that occur under your account.

4. Merchant Responsibilities

As a Merchant, you agree to:

Provide accurate and complete information about your products
Fulfill orders in a timely manner
Comply with all applicable laws and regulations
Not sell prohibited items including illegal goods, counterfeit products, or harmful content
Handle customer data in accordance with applicable privacy laws

5. Payments and Fees

Transaction fees are charged as outlined on our pricing page. Fees are non-refundable except as required by law. We reserve the right to change fees with 30 days notice.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

xcl4w2 IS PROVIDED "AS IS" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
WE ARE NOT LIABLE for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
WE ARE NOT RESPONSIBLE for any transactions between Merchants and their customers, including disputes, refunds, chargebacks, or fraudulent transactions.
WE ARE NOT LIABLE for any losses resulting from unauthorized access to your account, API keys, or cryptocurrency wallets.
WE ARE NOT RESPONSIBLE for the actions, products, or services of any third party, including AI agents that interact with the Platform.
WE ARE NOT RESPONSIBLE for any agent errors, bugs, malfunctions, unintended behavior, or any actions taken by automated systems or AI agents.
WE ARE NOT RESPONSIBLE for any store errors, product listing mistakes, pricing errors, inventory issues, or delivery failures.
WE ARE NOT RESPONSIBLE for any loss of money, cryptocurrency, tokens, or assets of any kind, whether through platform use, token purchases, or any other means.
WE ARE NOT RESPONSIBLE for any losses from $XCL4W2, memecoins, or any cryptocurrency associated with or promoted on the platform.
OUR TOTAL LIABILITY shall not exceed $0 (zero dollars). We provide no refunds, compensation, or reimbursement for any losses whatsoever.

7. Platform Availability and Termination

WE RESERVE THE ABSOLUTE RIGHT TO:

DISCONTINUE THE PLATFORM at any time, for any reason, without prior notice, and without liability to you or any third party.
MODIFY OR REMOVE any features, functionality, or content at our sole discretion without compensation.
DELETE ALL DATA including stores, products, transaction history, and user accounts without backup or recovery options.
SUSPEND OR TERMINATE any user account at any time for any reason or no reason at all.

YOU ACKNOWLEDGE THAT WE MAY TAKE THE WEBSITE DOWN PERMANENTLY AT ANY TIME AND YOU WILL HAVE NO CLAIM, RIGHT TO COMPENSATION, OR LEGAL RECOURSE AGAINST US.

8. Indemnification

You agree to indemnify, defend, and hold harmless xcl4w2 and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

Your use of the Platform
Your violation of these Terms
Your violation of any third-party rights
Products or services sold through your store
Any disputes with your customers

9. x402 and Cryptocurrency

The Platform supports x402 protocol for cryptocurrency payments. You acknowledge that:

Cryptocurrency transactions are irreversible
We are not responsible for lost, stolen, or misdirected cryptocurrency
Cryptocurrency values are volatile and may change significantly
You are responsible for compliance with cryptocurrency regulations in your jurisdiction

10. $XCL4W2 Token Disclaimer

THE $XCL4W2 TOKEN IS A COMMUNITY TOKEN WITH NO GUARANTEED VALUE OR UTILITY:

NOT AN INVESTMENT: $XCL4W2 is not an investment, security, or financial instrument. Do not purchase $XCL4W2 expecting any financial return or profit.
NO GUARANTEED VALUE: The token may have zero value at any time. Token prices are determined solely by market activity and we make no guarantees about price or liquidity.
NO PROMISES: Any future utility, features, or integrations described are aspirational only and may never be implemented. We are under no obligation to develop any token utility.
COMPLETE RISK OF LOSS: You may lose 100% of any funds used to purchase $XCL4W2. Only use funds you can afford to lose entirely.
NO LIABILITY: xcl4w2 and its affiliates accept absolutely no liability for any losses, damages, or claims arising from the purchase, sale, holding, or use of $XCL4W2.
YOUR RESPONSIBILITY: You are solely responsible for any tax obligations, regulatory compliance, and legal consequences related to $XCL4W2 in your jurisdiction.
THIRD-PARTY LAUNCH: The token is launched on pump.fun, a third-party platform. We are not responsible for pump.fun's operations, security, or any issues arising from their platform.

11. AI Agents and Automated Systems

The Platform is designed to interact with AI agents. You acknowledge and agree that:

We do not control, endorse, or verify any AI agent that uses the Platform
Transactions with AI agents are entirely the responsibility of the AI operator
We are not liable for any actions, errors, malfunctions, or unintended behavior of AI agents
AI agents may make mistakes, process incorrect data, or execute unintended transactions
You assume all risk when interacting with or operating AI agents on the Platform
We provide no guarantee that AI agents will function correctly, safely, or as intended
Any losses resulting from AI agent behavior are solely your responsibility

12. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Platform ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting on the Platform. Your continued use constitutes acceptance of the modified Terms.

You are solely responsible for any financial losses, including but not limited to losses from cryptocurrency transactions, token purchases, store operations, or agent interactions.
You agree not to hold xcl4w2 responsible for any errors, bugs, malfunctions, security breaches, or any other issues that may occur.
You are acting of your own free will and have sought any legal or financial advice you deem necessary before using the Platform.

IF YOU DO NOT AGREE TO ASSUME FULL LIABILITY, YOU MUST STOP USING XCL4W2 IMMEDIATELY.
